User Agreement

Terms of Use
The World Wide Web site with its home page in the domain "cancernavigator.org" (the "Web site") is a complimentary information and interactive community service offered by San Diego County Cancer Navigator ("CNAV") at no charge to users of the World Wide Web, with the express condition that these users agree to be bound by the terms and conditions set forth in this User Agreement. CNAV reserves the right to change these terms and conditions any time, without notice to you, and you must consult the most recent version of this User Agreement (not an older cache version) each time you view the Web site. Use of this Web site constitutes your acceptance of all the following terms and conditions, in their current form or as modified.

Description of Service
CNAV currently provides users access to an extensive amount of resources, including, but not limited to, public forums, health and medical content, online tools, calendaring, and e-mail (the "Service"). CNAV assumes no responsibility or liability for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization data or settings. All such risks shall be borne by you.

Registered User Account, Password, and Security
As an option, users may register and create a personal account profile to provide more personalized information. Users are responsible for maintaining the confidentiality of the user ID and password, and are fully responsible for all activities that occur under their account. CNAV does not retain liability or responsibility for such use.

User Submissions
By submitting communications or content to any part of the Site where such content would be viewable by the public (e.g. posting a public forum/bulletin board or public chat or other public communication), you agree that such submission is nonconfidential for all purposes. Any submission to the Web site will be deemed and remain the property of CNAV. You grant or warrant that the owner of such content has expressly granted CNAV a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form, format, or forum now known or hereafter developed.

Modifications to the Service

Termination
You agree that CNAV, in its sole discretion, may terminate your password, account (or any part thereof) or use of this Service, and remove and discard any content within the Service, for any reason, including, without limitation, for lack of use or if CNAV believes that you have violated or acted inconsistently with the letter or spirit of this user agreement. You agree that any termination of your access may be effected without prior notice, and acknowledge and agree that CNAV may immediately deactivate or delete your account and all related information and files in your account and/or bar further access to such files or the service. Further, you agree that CNAV shall not be liable to you or any third party for any termination of your access to the Service.

Data Collection

We collect two types of information:

  1. Standard Web server traffic pattern, general traffic, site usage, and length-of-stay information data are collected and stored in log files. This type of information is shared externally only on an aggregated basis.
  2. Personal information. We do not collect personally identifiable information from you unless you provide it to us voluntarily and knowingly. If you personalize a Web site, volunteer, order a book, request information, or donate, for example, we may collect the following information: first and last name, street address, city, state, zip code, telephone number, e-mail address, and subject of inquiry.

    Personal information may be needed for certain optional online activities: Registration: If you choose to customize the Web site to your needs by becoming a registered www.cancernavigator.org Web user, we retain the preferences you select so that you will not have to re-enter the information each time you access our Web site. These preferences may include requests for e-mail, news, information on specific cancer types, language preferences, and interest group selections (patient, medical, professional, volunteer). You can access your profile by entering your user name and password each time you use the Web site. You are not required, however, to enter your name or mailing address.

Data Use
We limit the use if information provided to us on our Web site to the following:

Internal Use

  1. If you do not make a service request, donation, purchase, or otherwise identify yourself, we will have no personally identifiable information about you. We will only use aggregate information derived, in part, from your use of our site to improve our site and our service to you.
  2. If you provide personal information, we may enter your name into our constituent database and contact you in order to:
    • Complete voluntary surveys seeking feedback for quality and service improvements purposes.
    • Supply you with information including cancer related health news, CNAV programs, events, and services.
    • Request voluntary time or monetary contributions to CNAV.
    • Request your participation in a CNAV research study.
  3. We collect the e-mail addresses of those who communicate with us by e-mail. Inquiries may be forwarded to the appropriate CNAV department for response and may be entered into our constituent database. If your name is entered into the database, we may contact you (see (2) above).

External Use
Your health-related information is privileged and confidential and will not be shared or released to any organization or business entity other than those affiliated with or working in conjunction with CNAV as follows:

We are committed to protecting the security of your personal information and to honoring your choices for its intended use. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of the information, we strive to maintain physical, electronic, and administrative safeguards.

Inside CNAV, data is stored in password-controlled servers.
